Josh Holly is the hacker who leaked racy photos of Miley Cyrus online. Now Holly and his lawyer are trying to keep him out of jail, saying he is too short for prison, and he would get the sh*t kicked out of him.

Holly’s lawyer also says that probation should be enough considering the crime. His lawyer says probation would be “sufficiently onerous punishment for a first-time offender of immature mental age,” according to legal documents.

Of course Holly didn’t really hack into Miley’s account. He was able to guess the password from the security question.

T.I. is back out of federal prison and will finish the remainder of his 11 month sentence in an Atlanta halfway house.

The rapper’s lawyer, Steve Sadow, told MTV News that T.I. will be finished his sentence by September 29 assuming everything goes to plan.

“[T.I.] went through a disciplinary hearing held before the ‘Center Disciplinary Committee’ (composed of Community Corrections-halfway house-staff) who recommended that he be returned to the halfway house,” Sadow confirmed in an emailed statement.

“We have good reason to believe that this favorable result was reached because of the pro-active and assertive approach taken to protect T.I.’s rights by providing [Federal Bureau of Prisons] officials and the media with reliable and accurate information that T.I. did not intend to violate his transfer furlough or any other [Federal Bureau Prisons] rules en route from the prison facility in Arkansas to the halfway house in Atlanta,” Sadow told TMZ. “T.I. will be released from the custody of the [Federal Bureau Prisons] on September 29th, and then will be supervised by the U.S. Probation Office for a period of one year.”

Good for T.I. and this whole story is pretty ridiculous.

Here’s a lesson for everyone – if you are ever released from prison, be very specific about everything to the Warden, including your transportation home.

T.I. was thrown back in jail because he told the prison he would be transported to the Atlanta halfway house by a van, not a decked out tour bus. This apparently is a violation. However, TMZ reports prison guards took pictures with T.I. before he got on the bus.

T.I.’s wife told TMZ, “This is a bunch of bulls**t … they should have said something before he got on the bus … T.I. would have politely gotten into a van.”

She adds, “T.I. is one of the strongest individuals I know … and they just trying to break him in more ways than one and it’s not gonna work! ‘Cause what God got for him, can’t no man take that away … period!”

This is absolute bullsh*t. There were no drugs on the bus and he wasn’t hurting anybody by taking a pimped out bus. Leave the guy alone.

Well that was a quick dose of freedom. T.I. is back in jail – yes you read that correctly. He hasn’t even been out for 48 hours.

T.I.’s lawyer claims there was an issue regarding the luxury bus the rapper took from the Arkansas prison where he was released.

His lawyer told TMZ, “We are awaiting the opportunity to quickly resolve whatever the issue may be that the Federal Bureau of Prisons has with TI’s method of transportation, bus, from Arkansas to Atlanta, so that T.I. can return to the halfway house to complete the remaining days of his sentence.”

T.I. was supposed to complete his sentence at an Atlanta halfway house.

T.I. isn’t out of prison 24 hours, and he already has a reality TV show with VH1.

VH1 says the show follows T.I. as he “re-adjusts to life as a free man after being incarcerated for nearly a year in a Federal prison in Arkansas.”

The show will follow the personal moments as T.I. is “reunited with his wife and kids and thrust back into society at this crucial juncture in his life.”

This is just further evidence of how Ja Rule is such a poser, and is the most ungangster guy. There’s one thing about going to jail for murder (not that we condone that) or dealing drugs – but tax evasion?

Ja Rule got tacked on another 28 months in prison for tax evasion for failing to file tax returns with the IRS for more than $1.1 million in taxes. Ja Rule’s lawyer told MTV News, ”We were all very concerned about what the potentials were, and we think that the outcome was very fair and that the court took him into account as an individual, and we appreciate that tremendously,” she said.

Ja Rule is already serving time for attempted gun possession stemming from a 2007 arrest. This guy is getting what he deserved. Don’t screw around with guns and pay your taxes.

Ja Rule is set to go to to prison, reports Billboard.

The rapper and actor was sentenced to two years in a New York prison on Wednesday, after pleading guilty in December to attempted criminal possession of a weapon.

“My last day out,” he wrote on Twitter yesterday afternoon, adding that he was spending it at the movies with his family.

Police officials said they found a loaded .40-caliber semiautomatic gun in the rear door of his $250,000-plus Maybach sports car in 2007, which they had stopped for speeding.

“Laws are laws,” Ja Rule said Monday on ‘Good Day New York.’ “There’s nothing I could really do but own up to the situation.”

“You know, I try not to regret anything I do in life, because you go through life and you do things, and you man up to them. You own them.”

In other legal news, Ja Rule also pleaded guilty to failing to pay taxes on more than $3 million in income. He faces up to three years in prison in that case, but his lawyers are trying arrange for his sentences to be served at the same time. Smart decision: kill two birds with one stone.

Ja Rule may be able to cut six months off his sentence by meeting requirements for good behaviour. Hopefully he learns his lesson, he seems to be pretty aware of the situation.

Lindsay Lohan has been ordered to undergo psychological counselling, reports CTV.

The troubled actress has also been sentenced to three years probation, attend The Shoplifter’s Alternative program, pay fines of $180 and stay away from jeweller Kanofie and Co. after pleading no contest to stealing a necklace from the store.

Lohan didn’t appear in court this morning for the sentencing.

Last month, Lohan was deemed to have breached the terms of her 2007 probation, which was set following a driving under the influence conviction, because of the theft charges. She was sentenced to 480 hours of community service and 120 days jail, for which she must turn herself in on June 17.

The 24-year-old star, who began her community service last week, has made an application to serve the jail term under house arrest, a move which is expected to be approved.

“I’ve made a lot of poor decisions in the past and I’m dealing with the consequences of those decisions, so there were times when I was concerned but I’m a fighter and I know that I have a lot of work to do to gain the respect back and I’m willing to do the work that I have to do to be an actress,” said Lohan in an interview.

Hopefully this is the last time she goes through this. She got really lucky this time around, and I’m rooting for her to finally, finally, get back on track.

Lindsay Lohan’s court date finally arrived on Friday, and it wasn’t pretty.

The court date over the infamous stolen necklace did not go well at all. In fact, Lohan was sentenced to 120 days in jail for violating her probation. Mugshot, prison cells, orange jumpsuit… Deja Vu, much?

Judge Stephanie Sautner has also sentenced Lohan to 480 hours of community service. But it gets better: 360 of those hours must be completed at the Downtown Women’s Center, so that Lindsay can see how needy women have to live. The remaining 120 hours will be served at the L.A. County morgue. Tough? Yes. But does she need to be taught the hard way? You bet.

Lohan was taken into custody on Friday afternoon and taken to the basement of the courthouse for booking. Lindsay’s lawyer will immediately file an appeal, which would allow her to post bond, since the case involves a misdemeanor violation.

Judge Sautner explained that Lindsay should have called the jewelry store and notified the owners about the “missing” necklace sooner. Instead, Lohan waited several weeks and returned the necklace after learning that the cops were about to raid her house.

Sautner was said to be influenced by the surveillance video, which she saw for the first time in court on Friday. Sautner also agreed with prosecutor Danette Meyers, who argued Lohan used her friend Patrick as a decoy to distract the clerk.

I feel bad, but hopefully these repeated jail stints will somewhat cause her to get on the better path. Girl needs to be taught.

Today News reports ‘Survivor’ winner Richard Hatch has been ordered to go back to prison to serve a nine-month sentence for failing to pay taxes on the $1 million he won on the first season of  ”Survivor.”

The reality star, who is currently appearing on NBC’s “The Celebrity Apprentice,” spent more than three years in prison for tax evasion and was released in 2009. Since then he has been serving a three-year term of supervised release. During this period, he was supposed to refile his 2000 and 2001 taxes and pay what he owed, but he never did. Shocker.

During the hearing, Hatch told the judge that he had fully cooperated with the terms of his release, and that his taxes were extremely complicated and he was working with an accountant to determine from the IRS what he owed.

Hatch also told the judge he recently discovered he had a second son and was trying to build a relationship with him. He asked that, because of that and the job opportunities that could come out of his “Celebrity Apprentice” appearance, not to send him back to prison.

I mean, really? You think the judge is going to let you go because you found out you have a son and are on a reality show? Please, if you’re stupid enough to go to jail for something, be released, and do the wrong thing AGAIN, you deserve to go to jail. I have no remorse for this guy. You won a million dollars. Pay your taxes.

I guess this is also going to interfere with The Celebrity Apprentice, which kind of sucks, because I watch the show and thought he was a really good competitor. I don’t understand all of this because on the show, Hatch seems like a really smart guy. How can someone so business-savvy forget to pay his taxes?

Part of me believes he’s willingly not paying them, but that’s just my suspicion. Guess he’ll have to survive in jail for another nine months.

Another chapter of the Lohan family drama unveils.

Lindsay Lohan’s father Michael went live on the radio this morning to talk about Lindsay’s court trial, their family problems, and anything else he could exploit to the media. In the radio interview, found on PerezHilton.com, Michael claims Dina has snorted cocaine with Lindsay in the past. When asked if Dina was an enabler for Lindsay, Michael had this to say.

“She drank, she partied, she did coke with Lindsay – give me a break,” said Michael.

“At the begining, before Lindsay went to Betty Ford, Dina was still saying ‘my daughter doesn’t have a problem, she’s fine.’ But now that everyone knows she does and when she admitted it, now she’s coming clean and saying she knew it all along.”

This revelation doesn’t really come as a surprise to me. I mean, everyone knows that Dina’s parenting skills have never been exceptional. Now, to believe this announcement or not is the other issue. Michael has had a long history of lying and stretching the truth to the media, so maybe he is making this up to get back at his ex. It’s obvious they aren’t on the best of terms.

What I do know is that I feel bad for Lindsay. Between her court trials and personal issues, the last thing she needs right now is a very public feud between her parents. Plus, bringing up her drug past is surely not going to help her in her trial. I don’t care how fair the judge claims to be, if they see that Lindsay’s parents are feuding, talking about her drug past, or whatever it may be, this will obviously lead them to see Lindsay in a negative light. Do I think Lindsay is an innocent little angel? No. Did she steal the necklace? Probably. But is it fair that her parents expose her personal life for the whole world to see? Is it okay that I’m sitting here writing about it? No. I can only pray for Lindsay.

Lindsay is still on trial for allegedly stealing a necklace valued at $2,500 from Kamofie & Company. There is supposed video evidence of Lindsay stealing the necklace, but she continues to plead her innocence. The jewlers have had suspicious info in their claims as well, such as the necklace being way overpriced and inconsistencies in their facts.

It has been learned that Lindsay is most likely going to jail for up to six months if sentenced in Judge Keith Schwartz’s court.

Wesley Snipes was found guilty in federal court on tax evasion charges in 2008 and has since been appealing the conviction.  He was sentenced to 3 years in prison, but up until now he hasn’t served one day.

For over two years Snipes had been trying to stay out of the slammer, but the actor was taken into custody earlier today after a judge ordered Snipes to quit playing games and do his time.

TMZ confirmed the news with the Federal Bureau of Prisons and Snipes is said to be “in transit” to a federal prison—where he will start his 3 year sentence.

We reported earlier that Lil Wayne will be on probation for the next three years of his life and must comply with the terms or face punishment.

Well, the terms of the probation were finalized and came into effect today.  Among them, written in documents obtained by TMZ, it is stated that Weezy “may not consume or drink any substance containing alcohol.”

It sucks for him, considering that he’s planned a huge party for this weekend to celebrate his release from prison—including at least 48 confirmed bottles of bubbly.  I guess his friends will just have to drink twice as much for him!

…Although those friends can’t have a criminal record.  Another one of the terms of Lil Wayne’s probation makes it clear that the rapper can’t associate with any person who has a criminal record.

If you’re a fan of Lil Wayne, you know that he’s been released from jail.  Now that he’s out of the slammer, though, he must serve three years of probation.

TMZ reports that Weezy landed in Yuma, Arizona to meet with the local probation department and start the three year sentence.

The incident that landed the rapper in prison in the first place occurred in Yuma at a U.S. Border Patrol checkpoint, where officers found cocaine, ecstasy and a handgun.  The felony drug charge is what put Weezy behind bars, with the other charges being dropped.

Lil Wayne will serve three years of unsupervised probation and also must complete 360 hours of community service—which will be carried out where he lives in Miami.

Sources say that if Lil Wayne has good behaviour, he might be able to get the felony charge dropped to a misdemeanour, which would be a positive if the rapper feels the need to go on tour with a bus filled with firearms and drugs.

TMZ is reporting that rapper T.I. had his probation revoked Friday by a federal judge and subsequently sentenced to an 11-month stint in jail.

The popular rapper had been put on probation as a result of a 2009 federal gun possession conviction, and then was arrested again last month for felony possession of a controlled substance.

This news comes just two days after T.I. talked a man from jumping off of a 22-storey building.  According to TMZ, one of the officers that was involved in that case testified on behalf of T.I.

In the continued competition for the biggest celebrity douchebag Dad, Michael Lohan maybe taking the lead beating out both Levi Johnston and Jon Gosselin.

Michael Lohan, father of celebrity wreck Linsday Lohan, issued a statement to PopEater.com explaining why his daughter was released from jail.

“As you know, thank God, Lindsay was released from jail tonight. However, what what most don’t know is that her release wasn’t due to the efforts of any one person. She was released because that’s what God wanted.

Lindsay walked into court, convinced by the ‘machine’ that she would ‘skate’ on the violation, but as it was, that did not happen. As a matter of fact, as was the case last time, Lindsay was misled.”

Lohan added:

“Unfortunately, this is NOT over yet. Lindsay still has to appear before Judge Fox (the same judge Shawn Holley just slapped in the face) on Oct 22. At which time, she will have to face his decision on the violation itself.

Dina and I caused this (by divorcing) and it’s our job to fix it. I pray that Dina and I can come to terms and do just that.”

What an amazing effort by this guy to milk his daughter’s own problems for his own celebrity. Granted we don’t think Dina Lohan is any prize of a Mother, but she has to be better than this schmuck!

Are you missing Lil Wayne? Well don’t cry anymore because the imprisoned rapper has a solution.

Yesterday (April 2nd) Weezy launched Weezythanxyou.com which he will be posting weekly blogs and responses to fan letters, according to MTV.

“Your letter was so thoughtful and sincere,” he wrote in response to Nurris Terrero of New York. “The way you worded everything left me in awe. Please send suggestions on books I should read. I look forward to checking them out.”

In his first post, Wayne explains that he keeps busy by working out and reading the bible. Additionally he announced that his ESPN blog will continue where he offered his 2 cents on sports.

Weezy also spoke about how his incarceration is affecting his family. “My kids race through my mind all day. They know they were created with love, so love is how their life will be defined. I just hope my love and adoration for them provides a temporary bandage on a wound I unknowingly inflicted on them.”

Lil Wayne is not getting any special treatment in jail, and is not considered a celebrity. TMZ has learned that the star has been instructed by prison officials not to sign a single autograph while in jail.

A prison representative told TMZ that Lil Wayne has not asked for anything out of the ordinary, and is serving a standard prison sentence. Weezy is serving a year long sentence for gun charges at Rikers Island in New York.

After delays that included a fire and a dental emergency, Lil Wayne is finally of to jail. The rapper will begin his one year prison sentence starting today stemming from a 2007 gun arrest.

In the past few weeks, Lil Wayne has been working in overdrive to clean up some loose ends. These delays have allowed him to complete some music videos and songs in order to continue airplay during his prison stint.

MTV News spoke with a New York State corrections officer about how Lil Wayne will be housed.

“He’ll be housed with inmates who are classified in his category, and he’ll be able to be a regular inmate,” the guard said. “He’ll be able to watch television, go into the day room and congregate with people of his classification.

“He’ll have no preferable treatment at all. He’ll be treated like a regular inmate,” the guard, who declined to be identified due to the classified information he discussed, added.
