Some are calling this one of the most important cases ever with regards to online file swapping. Next week, the U.S. Supreme Court will hear the cases against peer to peer file sharing programs Morpheus and Grokster, as the Motion Picture Association of America (MPAA), the National Music Publisher’s Association of America (NMPAA) and the Recording Industry Association of America (RIAA), attempt to convince the judge that the aforementioned services were created for the sole purpose of trading material that is copyright online. Case number 04-480 will be heard on March 29.
It’s really a shame that corporate America continues to deal with its problems in the courtroom. What they fail to see is the potential in this technology. Imagine a network of millions of people worldwide with the ability to transfer files within seconds. That’s exactly what these programs do. But instead of trying to shut this technology down, why not embrace it? Record labels could release music that is protected with various digital rights management software, allowing a person to only listen or burn a track once they pay for it.
What it boils down to is this. P2P has made the trading of copyrighted materials a lot easier than in the past. However, if the judge rules against the file swapping programs, it’s going to have a damaging effect on many other things. Devices such as CD Burners, VCRs, and tape recorders could become illegal. Or better yet, the companies who invented them could be sued for millions.
Back in 1984, Sony was sued for their Betamax technology because it allowed people to violate copyright laws. Sony won that case setting a precedent for what will be a long and intense battle in the coming weeks.

Brianna LaHara, a 12 year old girl from New York City, was charged yesterday for downloading copyright material on Kazaa.
Brianna did not think she was doing anything illegal as her family actually pays a service fee to Kazaa.
“I thought it was OK to download music because my mom paid a service fee for it. Out of all people, why did they pick me?” Brianna told Fox News.
The RIAA has no idea how old anyone is, as no personal information is every gathered. Whether or not the RIAA is going to go forth with this charge is unknown at this time.
Update: The family has settled with the RIAA For $2000US.
The RIAA is about to unveil what they call an “amnesty program” that will allow users, who are caught downloading copyrighted music, a way out.
Users will be required to sign an affidavit that promises no more use of peer to peer services, such as Kazaa, and to delete all their illegal music. If they are caught again, they may face criminal charges.
Yesterday, we reported that Universal Music will be lowering prices on their CD’s to help stimulate the falling sales.
The RIAA said it will not target small time music swappers on popular P2P services. The decision was given in writing after Sen. Norm Coleman called the investigation “excessive.”
“RIAA is in no way targeting ‘de minimis’ users,” wrote Cary Sherman, the group’s president, in a letter the subcommittee released Monday. “RIAA is gathering evidence and preparing lawsuits only against individual computer users who are illegally distributing a substantial amount of copyrighted music.”
The RIAA has not said how many files you must be sharing before they decide to come after you. If convicted, damages per song could carry penalties of up to $150,000.
