Carly Simon Singer Carly Simon is suing Starbucks for not adequately promoting her April 2008 album, This Kind of Love, reports CBC. The Grammy winner is seeking between $5 million and $10 million because her album was not offered in a substantial number in the coffee company’s stores, and was later sold at a reduced price.

Starbucks is saying it met all contractual obligations, even promoting the album in New York City and Boston longer than required.

“Unfortunately, sales continued to lag as the title received tepid response from music consumers,” the Seattle-based coffee giant said in a statement. “Other retailers faced the same fate with this CD.”

While the album was meant to be Simon’s final record, the 64-year-old is releasing a reworking of her hits later this month on her son’s label.
