Sam Lutfi, a close friend of Britney Spears, failed to appear in court Friday, after being subpoenaed and called to testify in the ongoing Spears-Federline custody battle.

E! News reports Britney’s trusted confidante missed the appointment but that Kevin Federline’s lawyers will file a motion to compel Lutfi to appear for questioning in January.

The November 7 subpoena was not the first time K-Fed’s people attempted to get Lutfi to testify about Spears’ habits and behavior. Before he was finally served, it is reported that K-Fed’s camp had been trying to get hold of him since August.

E! News reports that Lutfi has spent plenty of time with Spears and her two sons, Sean Preston and Jayden James.

Other friends of the troubled singer have been called to testify, including the star’s cousin, Alli Sims and former manager Larry Rudolph.
