The man who claims SEAN ‘DIDDY’ COMBS thumped him at a post-Oscars party is now suing the rap mogul for assault and battery.

Realtor GERALD RECHNITZER claims he interrupted Combs while the rapper was attempting to chat up his fiancee outside a Roosevelt Hotel party in Hollywood, and the hitmaker took exception, and lashed out.

In court documents filed on Friday and obtained by TMZ.com, Rechnitzer claims Combs rudely asked, “What the f**k (are) you looking at, dude?” before threatening to “smack flames out of your ass”.

Rechnitzer then alleges Combs punched him in the jaw.

The realtor’s attorney states, “At no time was Plaintiff, who is five feet, seven inches tall with a slim build, ever a threat to Defendant.”

The lawsuit seeks unspecified compensatory and punitive damages.
