Woody Harrelson allegedly choked a member of the paparazzi outside Element night club, TMZ.com reports.

Harrelson, 45, was leaving the club with a group of people when TMZ photographer Josh Levine started snapping photos of the actor.

Harrelson then asked Levine to stop snapping photos and eventually approached the photographer and put his hand on the camera. When Levine told Harrelson he was just doing his job, the actor broke the photogs camera.

Another paparazzo on scene captured what happened next on video. Harrelson is shown in the video putting his hands around Levine’s neck and saying something else. The tape has no audio.

“Unfortunately, this is not the first or last time the paparazzi have provoked an incident with a celebrity,” Ina Treciokas, Harrelson’s publicist, told TMZ. “Mr. Harrelson is evaluating all of his legal options against the photographer.”

The Los Angeles Police Department is now conducting a criminal investigation into the incident.

“We’re going to present [the case] to the D.A.’s office,” detective John Padilla told TMZ. “With the tapes and all, it’s pretty good evidence.”

Padilla added that vandalism and assault and battery charges could be filed against Harrelson.
