Anna Nicole Smith’s real life nemesis has died.

E Pierce Marshall, the son of J. Howard Marshall II who was Anna Nicole’s late husband, has unexpectedly died due to an “extremely aggressive infection,” according to ET Online.

The death comes just before a decision is to be made on whether Smith or the younger Marshall are to receive the estate left behind by J. Marshall.

The dispute between the elder Marshall’s son and Smith, his widow, dates back to the elder Marshall’s death in 1995; Smith was awarded $174 million of the estimated $2 billion the man was worth. Ever since his death, Smith and his son have been battling in court over who deserves the money.

Smith says on her website out of respect for the privacy of the family, she will not be making a statement on the younger Marshall’s death.
