Oscar-winning actor Joe Pesci will go scot-free for allegedly punching a fan who took his picture in January.

Assistant State Attorney Jill Estey Richstone said on Wednesday that the Palm Beach County State Attorney’s Office will not file charges against Pesci because it was not likely that he would be convicted.

“The investigating officer was unable to determine who the primary aggressor was and there are no independent witnesses to the incident,” Richstone wrote in response to a police warrant request.

College student Juan Carlos Montenegro, 24, told police that he met Pesci on Jan. 22 at a Boca Raton, Fla. shopping centre parking lot. He shook the actor’s hand and told him he was a big fan. Montenegro then purchased a camera, and asked Pesci for a picture, but he refused, said the police report. When Pesci turned around and Montenegro snapped one anyway, the actor punched him, leaving his lip red and slightly swollen.
